GENERAL TERMS OF SALES

Our sales are concluded on Paris "Cash and Carry" terms, paid in Euros or, according to prior agreement, in exchange values. These sales are conditioned and governed by the following rules of goods exchange, accepted without reservation by the purchaser.

The rise of production costs (+37% on St. Steel, 35% on bottles), the charges on social security contributions + "35h paid 39", the rise of 50% of airway shipment prices, oblige to come back to transactions based on PROFORMA INVOICES, valid 15 days, including the date of issue.

1/ THE ORDER : All our catalogues contain an ORDER FORM to be photocopied. A clear and precise order avoids any risk of confusion or errors. If it is filled in correctly, it favourizes the fast issue of the PROFORMA INVOICE. The latter numbered document, precises the different costs including the shipment charges.

Our catalogues also contain the different means of payment, to be specified on the order. If the order form is correctly filled in, the numbered proforma invoice will be issued on the same day.

If everything is OK, the customer gives his or her agreement by sending the payment or the CREDIT CARD DIRECT DEBIT FORM.

Sending this authorization form, completely filled in with the proforma invoice number and signed + the handwritten words "Credit card direct debit permission", permits an immediate payment by credit card. If it arrives before 15h (local time), the order will be shipped on the same day. No distant payment by credit card can be accepted without this authorization .

2/ THE PAYMENT: The payment by internet or "at distance", secure only for the bankers, requires an authorization form entirely filled in and signed to complete the transaction. The other means of payment accepted by JET FRANCE CY are specified in the catalogue.

According to the law n° 80-335 from 12 Mai 1980, the payment of the proforma invoice makes the goods the property of the purchaser. The price for delivery of the goods to the purchaser will be quoted on the proforma invoice.

The same procedure applies to any return shipment for reparation or exchange, including during the warranty period: The purchaser covers all the shipping costs.

The payment of the French VAT is required for all orders from France. It is also required for orders from European Union member states, unless the purchaser has a valid European VAT number.

3/ SHIPMENTS : The average costs of PACKING, i.e. the preparation of a parcel for shipment, are estimated at 3% of the value of the goods with a minimum of 10 EUR per parcel. The shipping costs depend on the dimensions of the parcel, the gross weight and the shipping delay. The transport companies also have supplementary charges: Delivery on Saturday: + 7 €, delivery on top floor: + 5 €, delivery to personal addresses: + 5 €...

If details like the opening hours of the shop, the floor number, the access code of the building or the name on the mailbox are not mentioned on the order form, the transporter is liable to decline any responsibility for late delivery or no delivery at all.

The responsibility of JET FRANCE CY who acts for and under the responsibility of the purchaser, is limited to the conditioning of the parcel, the issue of the waybill with address of destination and other documents –(customs, insurance ... ). In case of shipment delay, our only engagement is to contact the transporter.

If a transporter recognizes the loss or destruction of a parcel and if the purchaser has paid the transport insurance, JET FRANCE CY will replace the lost parcel by a new one with the same contents.

4/ TRANSPORT INSURANCE

The purchaser is advised to take the option TRANSPORT INSURANCE which will permit them to obtain a replacement of their parcel if the latter is lost or damaged during the shipment"

( transport insurance = + 2,5% of the total amount of the invoice with a minimum of 6 Euros).

According to international agreements, the receiver of a parcel shall check the latter on receiving it, and, if the parcel appears damaged or deteriorated, he shall note written reserves on the transporter's waybill, and inform the transport company and JET FRANCE COMPANY by registered letter within three days of any damage discovered in presence of the transporter.

5/ The WARRANTY ON MATERIALS The date of purchase gives the purchaser, and only the purchaser, the right of a guarantee of satisfaction on the goods and the good functioning of the machines. The recent laws (august 2004) put tattoo products into the category of cosmetic products. Therefore the products of JET FRANCE COMPANY offer « supplier's guarantee » until "opening of the bottle" for inks, colours, sterilized and disposable products and "manufacturer's guarantee" for up to two years for the materials, like bag sealers, sterilizers and autoclaves.

The guarantee for « hand instruments » manufactured by JET FRANCE COMPANY includes the reparation or the exchange of the material in our workshop. Certain conditions have to be fulfilled for the appliance of this guarantee:

1/- A use in normal conditions. (8 / 9 volts for tattoo machines, not 15 / 20 volts) ;

2/- A use with normal materials of the JFC catalog, not any unstable power supply.

3/- Convenient connexion and manipulation (voltage and amperage)

4/- The machine must not be dismantled.

5/- The guidelines of our virucides must be respected (3% does not mean one cap)

6/- St. Steel products must not be cleaned with chlore. Heat sterilization shall not exceed 150 °C.

For every return of materiel there has to be a written agreement from JET FRANCE COMPANY mentioning the dysfunction and the quotation for the return. For returns from countries that are not members of the EU, it is advised to note on the parcel: « MATERIEL IN TRANSIT FOR VERIFICATION OR REPARATION UNDER GUARANTEE – TIME LIMIT 21 DAYS», this is to avoid to pay duties. You should also join a photocopy of the purchase invoice.

The inks, pigments, needles and all sterile materials can neither be returned nor exchanged, unless a mistake has been made and recognized by us.

This measure of hygiene linked to cosmetic products applies to all tattoo materials.(chapter X, art.513-10-2 , Law 2004-806 dated

9 août 2004) and therefore to every opened or damaged product.

In case of disagreement with these General Terms Of Sale appeal can only be made to the courts of Paris, France

ALL PRICES MENTIONED IN OUR CATALOG AND ON OUR WEBSITE ARE GIVEN WITHOUT VAT. THE MINIMUM AMOUNT FOR EACH ORDER IS 45 € (For orders of less than 45 €, an extra charge of 8 € has to be paid).
